Where consent is required, you may withdraw it. Withdrawal does not affect processing lawfully undertaken before withdrawal or processing supported by another lawful basis.

POLICY 2: TERMS AND CONDITIONS

1. Acceptance of Terms

These Terms and Conditions govern your access to and use of the Bothseason Equipment website and your dealings with us through online orders, quotation requests and other sales channels.

By using the website or placing an order, you agree to these terms, subject to any mandatory rights granted by applicable law.

2. Our Products and Services

Bothseason Equipment supplies and sources products in categories that may include:

  • Computers, laptops, IT equipment and accessories.
  • Fluke, Fluke Networks, Tektronix, Hioki, Megger, Kyoritsu, Testo and Chauvin Arnoux test and measurement equipment.
  • ABB, Siemens, Allen-Bradley, Omron and Mitsubishi Electric automation products.
  • Loctite industrial adhesives and maintenance products.
  • Electrical cables, transformers, switchgear and protection equipment.
  • Generators, UPS systems, batteries and power equipment.
  • Solar panels, inverters, energy storage systems and related accessories.

Product ranges are subject to availability, supplier terms and applicable restrictions.

References to third-party brands identify products that may be offered or sourced. They do not, by themselves, mean that Bothseason Equipment is an authorised distributor, agent or representative of those manufacturers.

3. Product Information and Specifications

We make reasonable efforts to ensure that product descriptions, images, specifications and prices are accurate.

However:

  • Product images may be illustrative.
  • Manufacturers may revise specifications, packaging or product ranges.
  • Availability and lead times may change.
  • Certain products may require confirmation of compatibility, configuration or technical specifications.

If a material error or incompatibility is identified before fulfilment, we will contact the customer to discuss appropriate options.

Customers purchasing industrial or technical equipment should confirm that the product meets their application requirements before ordering. We can assist with product enquiries but do not replace the customer’s obligation to obtain appropriate engineering, electrical or technical advice where necessary.

4. Quotations and Purchase Orders

Quotation requests do not constitute a confirmed order.

Unless otherwise stated on the quotation:

  • Quotations are valid for seven calendar days from the date of issue.
  • Prices and availability are subject to confirmation until the order is accepted.
  • Imported, special-order and project-specific products may have different lead times.
  • Delivery, installation, commissioning, training and other services are included only if expressly stated.
  • A purchase order must correspond with the agreed quotation and specifications.

A quotation may specify a different validity period, deposit, payment schedule, delivery arrangement or other special conditions.

A binding sale is concluded when the order has been accepted by Bothseason Equipment and the applicable payment or credit terms have been agreed.

5. Pricing and Payment

Prices displayed on the website or in quotations will identify applicable taxes, delivery charges and other fees where required by law.

Unless otherwise stated, quotations are in South African rand (ZAR).

Available payment methods will be communicated during checkout or on the quotation. Orders may be subject to payment verification.

For quotation-based orders, deposits, progress payments or full advance payments may be required where disclosed and agreed.

We reserve the right to correct genuine pricing errors before accepting an order. If an error affects an order that has already been accepted, we will contact the customer to agree on a lawful resolution. We will not treat an incorrect price as an automatic entitlement to cancel an accepted order regardless of the circumstances or applicable law.

6. Order Acceptance and Availability

An order acknowledgement does not necessarily mean that an order has been accepted for fulfilment if further verification is required.

If a product becomes unavailable after an order has been accepted, we will notify the customer and explain the available options, including an appropriate refund where required.

We will not substitute a different product or materially different specification without the customer’s agreement, except where the law permits otherwise.

7. Delivery

Delivery dates are estimates unless a specific date or period has been expressly agreed.

Delivery arrangements, charges and estimated timelines will be communicated during checkout or in the quotation.

Customers must provide accurate delivery details and ensure that someone authorised is available to receive the order.

Additional charges arising from an incorrect address, failed delivery or requested redelivery will be disclosed and applied only where lawful and appropriate.

Risk and responsibility for goods will be determined in accordance with applicable law and the agreed delivery terms. Nothing in these terms removes rights that cannot lawfully be excluded.

8. Cancellation, Returns and Refunds

Orders may be cancelled or returned in accordance with our Returns and Refunds Policy and applicable South African law.

Special-order products, personalised goods, software, sealed items and other product categories may be subject to particular statutory rules. Any applicable restriction will be assessed in accordance with the law and the circumstances of the transaction.

Nothing in these terms excludes a consumer’s statutory cancellation, return, repair, replacement or refund rights.

9. Warranties

Products may carry a manufacturer’s warranty or a separate written warranty supplied by Bothseason Equipment.

Warranty periods and conditions may vary by product, manufacturer and application.

Nothing in our warranty terms limits any statutory consumer rights that apply to the transaction, including applicable rights under the Consumer Protection Act.

10. Industrial and Electrical Equipment

Industrial test instruments, electrical protection products, automation equipment, generators, UPS systems and solar installations must be selected, installed and used according to their specifications and safety instructions.

Unless expressly included in writing, product supply does not include:

  • Electrical installation or wiring.
  • Engineering design or system sizing.
  • Site inspections or load assessments.
  • Commissioning, configuration or programming.
  • Certification, statutory inspection or compliance approval.
  • Installation labour or ongoing maintenance.

Installation and electrical work should be performed by appropriately qualified persons where required by law.

Customers must confirm voltage, current, phase, frequency, protection ratings, environmental requirements, battery compatibility and other relevant specifications before installation or use.

11. Intellectual Property

Website text, graphics, logos and original materials belonging to Bothseason Equipment may not be reproduced for commercial purposes without permission.

Third-party trademarks, logos, product names and manufacturer materials remain the property of their respective owners.

12. Website Use

You agree not to:

  • Use the website for unlawful purposes.
  • Submit fraudulent orders or false information.
  • Attempt unauthorised access to the website or its systems.
  • Interfere with website security or availability.
  • Copy, scrape or misuse website content in violation of applicable law.

We may restrict access where reasonably necessary to protect the website, customers or our business, subject to applicable law.

13. Limitation of Liability

Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by law.

To the extent permitted by law, Bothseason Equipment is not responsible for loss arising solely from misuse of products, unauthorised modification, incorrect installation by others, failure to follow safety instructions or use outside the product’s intended specifications.

This clause does not exclude liability for our own breach of contract, negligence, unlawful conduct or any other liability that cannot legally be excluded.

14. Force Majeure and Supply Disruptions

Where performance is affected by events beyond our reasonable control, including transport disruptions, supplier shortages, import delays, natural disasters or power interruptions, we will take reasonable steps to inform affected customers and agree on an appropriate way forward.

This clause does not override statutory cancellation, refund or other consumer rights.

15. Disputes and Governing Law

These terms are governed by the laws of the Republic of South Africa.

If a dispute arises, the parties should first attempt to resolve it through good-faith communication. Consumers may also approach a competent consumer protection body, tribunal or court where appropriate.

16. Changes to These Terms

We may update these terms from time to time. Changes will be published on the website. Changes will not retrospectively remove rights that have already accrued under an existing agreement or applicable law.

17. Contact Details

For questions about orders, quotations or these terms:

Telephone: [Insert business telephone]

POLICY 3: RETURNS, REFUNDS AND CANCELLATIONS

1. Our Commitment

Bothseason Equipment aims to supply products that meet the descriptions, specifications and quality standards applicable to each sale.

This policy explains how to request a return, exchange, repair or refund. It operates alongside the Consumer Protection Act, Electronic Communications and Transactions Act and other applicable South African laws.

Nothing in this policy limits a customer’s statutory rights.

2. Incorrect, Damaged, Defective or Incomplete Orders

If you receive a product that is damaged, defective, incorrect or incomplete, please contact us as soon as reasonably possible.

Provide:

  • Your order number or invoice.
  • The product name and model number.
  • A description of the problem.
  • Photographs or video evidence, where reasonably available.
  • Serial numbers or batch details, where applicable.

We will assess the issue and explain the next steps.

Where the product is covered by applicable statutory rights, the available remedy will be determined in accordance with those rights. Depending on the circumstances, this may include repair, replacement or refund.

Do not continue operating equipment that appears unsafe or is showing signs of electrical, battery or mechanical failure.

3. Seven-Day Cooling-Off Period for Qualifying Online Transactions

Under section 44 of the Electronic Communications and Transactions Act 25 of 2002, consumers may generally cancel qualifying electronic transactions for goods within seven days after receipt, without giving a reason and without a penalty, subject to the statutory exceptions.

The direct cost of returning the goods may be charged to the consumer where permitted by that section. Refunds under section 44 must be made within the statutory period.

The cooling-off right does not apply to every transaction. Statutory exceptions include certain financial services, auctions, goods made to the consumer’s specifications or clearly personalised, goods that cannot be returned by their nature, rapidly deteriorating goods, and other categories specified by law.

Where a statutory exception may apply, we will assess the actual transaction and applicable law rather than automatically refusing every return of that product category.

4. Defective Goods and the Six-Month Implied Warranty

Under section 56 of the Consumer Protection Act, qualifying consumer goods are subject to an implied warranty of quality.

Where goods fail to meet the applicable requirements and standards within six months after delivery, a consumer may be entitled to return them at the supplier’s risk and expense and choose the remedy provided by law, which may include repair, replacement or refund.

Where goods have been repaired and the relevant failure remains unresolved or a further qualifying failure occurs within three months after the repair, additional remedies may apply under section 56(3).

These statutory rights are not replaced by a manufacturer’s warranty or by a shorter warranty stated on a product listing.

5. Change-of-Mind Returns

Outside statutory cooling-off rights and other legally protected return rights, a change-of-mind return is not automatically guaranteed.

We may consider a voluntary return request for an unused standard-stock product if:

  • The product is in its original condition.
  • All accessories, manuals and packaging are included where reasonably available.
  • The product has not been installed, configured, activated or modified.
  • The request is made within a period expressly agreed by us in writing.

Any voluntary return conditions, restocking fees or return transport charges will be communicated in advance and applied only where lawful.

A voluntary return policy will not be used to refuse a return or remedy required by law.

6. Special-Order and Imported Products

Products sourced specifically for a customer may include industrial test instruments, automation components, transformers, generators, UPS systems, solar equipment and specialised replacement parts.

A change-of-mind return for such goods may be restricted where the law permits, particularly where a product is customised or made to the customer’s specifications.

However, special-order status alone does not remove statutory rights relating to defective goods, qualifying electronic transactions or other protected circumstances.

Before confirming a special-order purchase, customers should verify the model, part number, ratings, configuration, compatibility and required accessories.

7. Software, Sealed Products and Consumables

Software, digital products, activated licences, sealed products and consumables may be subject to specific statutory exceptions or restrictions.

Customers should contact us before opening or activating a product if they are uncertain about compatibility.

Nothing in this section removes rights that remain available under applicable law.

8. Industrial Equipment and Electrical Products

Returns involving test instruments, automation equipment, electrical protection devices, generators, UPS systems, solar inverters and batteries may require technical inspection.

We may request the following where relevant:

  • Model and serial numbers.
  • Error codes or fault descriptions.
  • Installation and commissioning records.
  • Details of voltage, wiring and operating conditions.
  • Evidence of installation by a qualified person where required.
  • Manufacturer diagnostic reports.

These requests help establish the nature of the problem. They will not be used to impose unlawful barriers to a valid statutory claim.

Products must not be dismantled, modified or repaired by unauthorised persons where doing so could create a safety risk or affect an additional manufacturer’s warranty. Any effect on a claim will be assessed on the facts and applicable law.

9. How to Request a Return

Contact us before sending a product back.

Returns contact: [Insert email address]
Telephone/WhatsApp: [Insert contact number]
Return address: [Insert approved return address]

Include your order number, invoice, product details and the reason for the request.

We will provide return instructions and, where appropriate, a return reference number.

Do not send goods to an unconfirmed address.

10. Return Shipping and Inspection

Where a return is required by law because goods are defective or fail the relevant statutory standards, return costs and responsibility will be handled in accordance with the applicable legal requirements.

For other returns, responsibility for return shipping will be communicated before the return is authorised.

Products should be packed securely. Where an inspection is necessary, we will keep the customer informed of any material findings and the proposed resolution.

11. Refund Processing

Approved refunds will be processed using the original payment method where reasonably possible, or another lawful method agreed with the customer.

Refund timing depends on the reason for the refund and the applicable legal requirements. For example, ECTA section 44 provides for refunds within 30 days following cancellation under that section.

Where a refund is legally due, we will not impose unlawful deductions or delays.

12. Order Cancellations

Customers should submit cancellation requests in writing as soon as possible.

If an order has not yet been dispatched or a special-order product has not yet been committed to a supplier, cancellation may be easier to arrange.

If an order has already been dispatched or procurement has commenced, the available options will depend on the contract, the circumstances and applicable law.

Any cancellation fee will be disclosed and charged only where legally permissible.

POLICY 4: SHIPPING AND DELIVERY POLICY

1. Delivery Coverage

Bothseason Equipment offers delivery within South Africa, subject to product availability, courier coverage, product dimensions, weight, transport requirements and any special arrangements stated in a quotation.

Certain large, heavy, hazardous or specialised products may require dedicated transport or collection arrangements.

International delivery, where offered, will be confirmed separately.

2. Order Processing

Orders are processed after the order has been accepted and any required payment, verification or documentation has been completed.

For quotation-based purchases, processing may begin after acceptance of the quotation and fulfilment of the agreed payment terms.

Processing times may vary for:

  • In-stock products.
  • Imported or special-order equipment.
  • Large or heavy products.
  • Configured or project-specific systems.
  • Products requiring manufacturer confirmation.

3. Delivery Estimates

Estimated delivery times will be provided during checkout, in order confirmations or in quotations, as applicable.

Delivery estimates are not guaranteed unless a specific delivery commitment has been expressly agreed.

Where ECTA applies, orders must be fulfilled within the agreed period or the statutory default period, subject to the applicable provisions of the Act.

If an order cannot be fulfilled within the applicable period, we will notify the customer and handle cancellation and refunds in accordance with the law.

4. Delivery Charges

Delivery charges depend on the delivery address, package dimensions, weight, transport method and any special handling requirements.

The applicable charge will be displayed at checkout or included in the quotation before the order is finalised.

Additional services, such as installation, offloading, lifting equipment, commissioning or on-site delivery, are not included unless expressly stated.

5. Customer Delivery Responsibilities

Customers must provide a complete and accurate delivery address, contact number and any relevant site-access instructions.

For business and industrial deliveries, customers should ensure that:

  • An authorised recipient is available.
  • The delivery site is accessible to the agreed vehicle.
  • Appropriate offloading arrangements are available where required.
  • Any site safety and access requirements have been communicated in advance.

Additional delivery arrangements must be agreed before dispatch where they affect cost or timing.

6. Delivery Inspection

Please inspect the external packaging and shipment upon receipt where reasonably possible.

If there is visible damage, missing packaging or an apparent shortage, record the condition and notify the courier and Bothseason Equipment as soon as possible.

Please retain the packaging, delivery documents and photographs where relevant.

Failure to report damage immediately does not automatically remove any statutory rights you may have.

7. Failed Delivery

If delivery cannot be completed because the address is incorrect, no authorised recipient is available or access is unavailable, we will contact the customer to arrange the next steps.

Redelivery or storage charges may apply where they are reasonable, disclosed and legally permissible.

8. Large, Heavy and Specialised Equipment

Generators, transformers, industrial machinery, large UPS systems and battery storage equipment may require special transport arrangements.

The quotation may specify:

  • Delivery to kerbside or a designated receiving point.
  • Specialised transport or handling.
  • Offloading responsibilities.
  • Site-access restrictions.
  • Separate installation or commissioning charges.

Customers must confirm any site-specific requirements before accepting the quotation.

9. Risk and Responsibility

Risk in the goods will be determined by the applicable law and the agreed delivery arrangement.

Nothing in this policy transfers risk to a consumer earlier than permitted by law or removes rights relating to goods damaged, lost or incorrectly supplied.

10. Delivery Delays

Delivery may be delayed by supplier shortages, import clearance, transport disruptions, severe weather, industrial action or other circumstances affecting fulfilment.

We will make reasonable efforts to communicate material delays and provide updated estimates.

Where a delay gives the customer a cancellation or refund right under applicable law, that right remains unaffected.

11. Collection

Where collection is offered, customers will be notified when their order is ready and advised of the collection location and requirements.

Collection may require proof of payment, an order reference and identification of the person collecting the goods.

12. Delivery Enquiries

For delivery updates or assistance, contact:

Email: [Insert business email]
Telephone/WhatsApp: [Insert contact number]

Please provide your order number or invoice reference when making an enquiry.

POLICY 5: WARRANTY AND PRODUCT GUARANTEE POLICY

1. Introduction

Bothseason Equipment supplies IT equipment, test and measurement instruments, electrical components, automation products, generators, UPS systems, solar inverters, batteries and related industrial equipment.

Warranty coverage depends on the product, manufacturer, product condition and any written warranty supplied with the item.

This policy explains how warranty enquiries and claims are handled. It does not replace or limit statutory consumer rights.

2. Statutory Consumer Rights

Where the Consumer Protection Act applies, goods are subject to the statutory protections and implied warranty of quality provided by law.

Under section 56 of the CPA, qualifying defective or non-compliant goods may be returned within six months after delivery for the remedies provided by law.

Where applicable, the consumer may choose repair, replacement or refund in accordance with the statutory provisions.

A manufacturer’s warranty or an additional written warranty does not remove those rights.

The application of the CPA depends on the transaction and the parties involved. Business-to-business transactions may be treated differently depending on the circumstances and applicable law.

3. Manufacturer Warranties

Some products carry warranties provided by their manufacturers or authorised warranty providers.

Depending on the product, these may include equipment from Fluke, Fluke Networks, Tektronix, Hioki, Megger, Kyoritsu, Testo, Chauvin Arnoux, ABB, Siemens, Allen-Bradley, Omron, Mitsubishi Electric and other manufacturers.

Manufacturer warranty terms may vary in duration, geographic coverage, registration requirements, service location and exclusions.

Where available, we will communicate the applicable manufacturer warranty information or direct the customer to the relevant warranty provider.

We do not guarantee a particular manufacturer warranty period unless it is confirmed for the specific product.

4. New, Used and Refurbished Products

The condition of each product will be stated in the product listing or quotation.

New products may carry the manufacturer’s warranty or another expressly stated warranty.

Used or refurbished products may have a different additional warranty, which will be disclosed before purchase.

A shorter commercial warranty for a used or refurbished product does not automatically remove statutory rights that apply to the transaction.

5. Warranty Claim Procedure

To submit a warranty claim, contact Bothseason Equipment using the details below.

Provide:

  • Proof of purchase, invoice or order number.
  • Product model and serial number.
  • Description of the fault or failure.
  • Date the problem was first noticed.
  • Photographs, videos or error codes where available.
  • Relevant installation or commissioning details where necessary.

We may request further information or an inspection to identify the cause of the problem.

We will explain whether the claim will be handled by Bothseason Equipment, the manufacturer, an authorised service provider or another appropriate party.

6. Inspection and Assessment

A product may need to be inspected or tested before a warranty decision can be made.

Where an inspection is required, we will communicate the arrangements and any applicable costs in advance.

No inspection fee or diagnostic charge will be imposed where prohibited by law or where it would improperly obstruct a valid statutory claim.

7. Common Warranty Limitations

An additional manufacturer or commercial warranty may exclude certain problems, depending on its written terms. Examples may include:

  • Physical damage caused after delivery.
  • Incorrect installation or wiring.
  • Use outside the manufacturer’s stated ratings.
  • Unauthorised modifications or repairs.
  • Neglect, misuse or failure to follow operating instructions.
  • Damage caused by incompatible accessories or external systems.
  • Consumables or components specifically excluded by the applicable warranty.

These exclusions apply only to the extent permitted by the applicable warranty and law. They do not automatically defeat a statutory claim, and each claim will be assessed on its facts.

8. Test and Measurement Equipment

Precision instruments, including multimeters, clamp meters, insulation testers, thermal cameras, oscilloscopes, network testers and power analysers, should be operated according to the manufacturer’s safety and calibration instructions.

Warranty coverage for measurement accuracy, calibration, probes, leads, batteries, accessories and consumables may differ from coverage for the main instrument.

Calibration certificates and recalibration services are included only where expressly stated.

A request for calibration, adjustment or certification is not necessarily the same as a warranty claim.

9. Electrical and Automation Equipment

Transformers, switchgear, circuit breakers, PLCs, sensors, relays, drives, motors and related components must be selected and installed according to their technical specifications.

Warranty assessment may require information about operating conditions, electrical ratings, installation, protection settings and system compatibility.

Installation, commissioning, programming and system integration are separate services unless expressly included in the quotation.

10. Generators, UPS Systems, Solar Inverters and Batteries

Warranty conditions for generators, UPS systems, solar inverters, batteries and energy storage equipment may depend on:

  • Installation and commissioning requirements.
  • Approved battery or accessory compatibility.
  • Operating temperature and environmental conditions.
  • Load, charging and discharge conditions.
  • Maintenance and inspection requirements.
  • Registration or commissioning documentation.

Customers should retain installation records, commissioning reports and maintenance records where applicable.

Where an installation or maintenance issue is suspected, qualified technical personnel should investigate the system safely.

11. Warranty Repairs, Replacements and Refunds

Where a valid warranty claim is accepted, the remedy will be determined by the applicable statutory rights and the relevant additional warranty terms.

Depending on the circumstances, the remedy may include repair, replacement or refund.

If goods are repaired and the statutory conditions for a further remedy are met, additional rights may arise under the CPA.

Replacement products may be new or otherwise appropriate to the agreed remedy, subject to applicable law and the terms of the transaction.

12. Transport During Warranty Claims

Transport arrangements will depend on the nature of the claim and the applicable warranty or statutory obligations.

Where a statutory remedy requires the supplier to bear the risk and expense of return, we will make the necessary arrangements in accordance with the law.

For other claims, we will explain any transport responsibilities before the product is sent.

Large or heavy equipment may require specialised transport arrangements.

13. Data and Software

Customers should back up important data before sending computers, storage devices or other data-bearing equipment for assessment or repair.

Where practical, remove personal information, passwords and confidential files before handing over equipment.

Software licences, firmware, configuration settings and digital services may be subject to separate manufacturer terms.

Any handling of personal information during warranty processing remains subject to our Privacy Policy and applicable data protection law.

14. Warranty Claims Not Covered by an Additional Commercial Warranty

If an additional manufacturer or commercial warranty does not apply, we will explain the reason where reasonably possible.

A refusal under an additional warranty does not automatically determine whether a customer has a separate statutory remedy. Statutory rights will be considered independently where applicable.

15. Contact for Warranty Claims

FINAL NOTICE

These policies are intended to provide customers with clear information about privacy, online transactions, quotations, deliveries, returns and warranties.

They should be read together with the product listing, accepted quotation, invoice and any product-specific warranty terms. Where there is a conflict, applicable law takes precedence, and any valid transaction-specific terms will be interpreted consistently with that law.

Bothseason Equipment may revise these policies when its services, operations or legal obligations change. The latest published version will be available on the website.
